In November 2025, Congress passed a spending bill with a provision called Section 781 tucked inside. It rewrites the federal definition of hemp. The President signed it on November 12, 2025, with a one year delay before it takes effect.
The new definition caps total THC at 0.4 milligrams per container. Full spectrum CBD, the kind that does not get you high, naturally contains trace THC. Industry estimates say roughly 90 percent of CBD products on shelves today would exceed the cap.

In September 2026 the President signed a funding bill that delays most of the restrictions to December 11. The White House has signaled this extension is the last one.
